Terms of service

Welcome. These terms govern your use of TopMyGrade. By creating an account, signing in, or using any part of the service you agree to them. If you don't agree, please stop using the service.
1. Who's offering this service
TopMyGrade is operated by Aartiq Consulting Ltd, a company registered in England & Wales. References to “we”, “us” and “our” mean Aartiq Consulting Ltd. Reach us at hello@topmygrade.com.
2. Eligibility
TopMyGrade is built for UK GCSE and A-Level students aged 11+. If you're under 13, a parent or guardian must create the account on your behalf and consent to these terms (see the privacy policy).
You must give accurate information when you sign up — particularly your role (student / parent / admin) and exam year, because the experience adapts to them.
3. Your account
You are responsible for keeping your password and any other access credentials safe. Tell us immediately if you suspect unauthorised use. We may suspend an account that's being misused (see “acceptable use” below) and we'll always tell you why.
4. Acceptable use
You agree not to:
- Use TopMyGrade to cheat in a real exam (we don't condone exam misconduct).
- Scrape, mass-download, or systematically copy our content (notes, questions, flashcards, worked solutions). Personal use only.
- Reverse-engineer, attempt to defeat rate limits, or otherwise interfere with the platform's normal operation.
- Use the service to harass, threaten or impersonate others, or to upload illegal content.
- Resell access to your account or use a single account to teach a class without our consent (we're happy to talk about school licences — email schools@topmygrade.com).
5. Content we provide
TopMyGrade displays three kinds of content, each with different ownership:
- Past-paper PDFsare © the relevant exam board (AQA, Pearson Edexcel, OCR, WJEC / Eduqas, CCEA). We link to the official board filestore wherever possible. Where we mirror PDFs to our own storage, we do so under the board's public-availability terms or with explicit permission from the source we got them from. Marks and questions remain the board's intellectual property.
- Notes, explainers, practice questions, flashcards generated by us (whether human-written or AI-assisted) are © Aartiq Consulting Ltd, licensed to you for personal study only.
- AI-generated worked solutions and tutor answersare produced on demand and are assistive — they may contain mistakes. Always cross-check important answers against the official mark scheme. We don't guarantee any particular grade.
6. Content you provide
You retain ownership of anything you upload (snap-solve photos, attempt answers, notes). By posting it to TopMyGrade you grant us a limited licence to host, display it back to you, and process it through our AI tools so we can give you feedback. We do not use your content to train AI models.
7. Pricing and refunds
TopMyGrade is currently free during the public beta. When we introduce paid features:
- Pricing will be stated in clear UK pounds at the point of purchase.
- We will offer monthly billing only by default — no annual auto-renewal traps.
- Subscriptions can be cancelled at any time and will run to the end of the paid period.
- A 14-day refund window will apply to first-time subscriptions (consistent with the UK Consumer Contracts Regulations 2013), provided the service has not been used materially in that period.
8. AI: what to expect, what not to
AI features (the marker, the tutor, worked solutions) are powered by large language models and are not infallible:
- Marks and feedback are indicative only. They may differ from what an exam-board examiner would award.
- Worked solutions can contain errors, particularly on multi-step or diagram-heavy questions.
- The tutor isn't a substitute for a teacher — it's a study companion.
- We don't guarantee uptime of AI features. If the underlying provider is unavailable, AI features may degrade gracefully (we'll show static content instead).
9. Service availability
We aim for high availability but don't promise 24/7 uptime. We'll publish scheduled maintenance windows in advance where possible. Outages may happen.
10. Liability
Nothing in these terms limits liability that can't lawfully be limited (death, personal injury caused by negligence, fraud).
Subject to that, our total liability to you for any loss arising out of these terms or your use of the service is capped at the greater of (a) the amount you've paid us in the previous 12 months, or (b) £100. We are not liable for indirect or consequential loss, loss of profits, loss of data, loss of opportunity (including missing or under-performing in an exam), or loss of reputation.
11. Termination
You can delete your account at any time from your settings or by emailing privacy@topmygrade.com. We'll erase your personal data on the timeline described in the privacy policy.
We may suspend or terminate your account if you breach these terms, particularly the acceptable-use rules. Where reasonable, we'll warn you first.
12. Changes to these terms
We'll notify registered users by email of any material change at least 14 days before it takes effect. Your continued use of the service after the effective date counts as acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over any dispute, save for consumers based elsewhere in the UK / EU who may bring proceedings in their local courts where mandatory law requires.
